These Terms and Conditions ("Terms") govern your access to and use of the AllicereTV website, streaming platform, services, features, accounts, and related content (collectively, the "Service"). These Terms constitute an agreement between you ("you," "your," or "User") and AllicereTV, doing business as AllicereTV ("AllicereTV," "we," "us," or "our"). By creating an account, accessing the Service, streaming content through the Service, making a payment or voluntary contribution, or otherwise using AllicereTV, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you may not use the Service. 1. Eligibility and Age Requirement You must be at least 18 years old, or the age of legal majority where you live if that age is higher, to create an AllicereTV account or use the Service. By creating an account or using AllicereTV, you represent and warrant that: - You satisfy the applicable age requirement; - You have the legal capacity to enter into a binding agreement; - The information you provide to AllicereTV is accurate and truthful; and - Your use of the Service does not violate applicable law. AllicereTV is not intended for children or minors. AllicereTV may require users to complete an age-verification process before granting access to certain portions of the Service. Age verification may require the submission of a government-issued identification document or other information reasonably necessary to determine whether the user satisfies the applicable age requirement. We reserve the right to suspend, restrict, or terminate an account if we reasonably believe that the account holder does not satisfy our age requirements, fails to complete required age verification, or provided false or misleading information regarding their age. 2. Age Verification and Identification Review To help ensure that the Service is accessed only by users who satisfy the applicable age requirement, AllicereTV may require age verification before providing access to the Service. Where age verification requires an identification document, you may be asked to upload a clear image of a valid government-issued identification document through the Service. The identification document may contain information such as your name, date of birth, photograph, identification number, address, or other information displayed on the document. AllicereTV requests this information solely for the limited purpose of determining whether you satisfy the applicable age requirement. Manual Review AllicereTV currently uses a manual review process for submitted identification documents. Your submitted identification document may be reviewed by an authorized AllicereTV administrator ("Admin") for the purpose of determining whether you satisfy the applicable age requirement. Access to submitted identification documents is restricted to authorized personnel who reasonably require access to perform the age-verification review. Submitted identification documents will not be intentionally used for advertising, marketing, profiling, or other purposes unrelated to age verification. AllicereTV does not intend to use submitted identification documents to create a separate identity profile or database for purposes unrelated to determining whether you satisfy the applicable age requirement. Review and Deletion Procedure The Admin will review an age-verification submission as soon as reasonably practicable and no later than 48 hours after the submission is received. The Admin may approve or reject the submission. Following the approval or rejection decision, the submitted identification image will be deleted from AllicereTV's active storage as soon as reasonably practicable and no later than 24 hours after the decision. Accordingly, under the normal verification procedure, an uploaded identification image will be retained for no longer than 72 hours from submission, assuming the full 48-hour review period and full 24-hour deletion period are used. AllicereTV does not intend to retain the submitted identification image as a permanent part of your account. The deletion of the identification image does not necessarily mean that all information relating to the verification process is deleted. AllicereTV may retain a record of the age-verification result, such as whether an account was approved or not approved, as reasonably necessary to operate the Service, maintain account security, prevent abuse, enforce these Terms, or comply with applicable law. Verification Decisions If you do not complete a required age-verification process, or if the information provided cannot reasonably establish that you satisfy the applicable age requirement, AllicereTV may restrict or deny access to the Service. Submitting an identification document does not guarantee approval. AllicereTV may reject a submission where the document: - Is unclear, unreadable, or materially incomplete; - Appears invalid, expired, altered, or fraudulent; - Does not reasonably establish that the user satisfies the applicable age requirement; - Is not a valid government-issued identification document; or - Otherwise does not satisfy AllicereTV's verification requirements. You are responsible for submitting only your own valid identification document. You may not submit another person's identification document or knowingly submit false, altered, fraudulent, or misleading information. Additional information regarding the collection, storage, security, use, retention, and deletion of identification documents and other personal information is provided in the AllicereTV Privacy Policy. 3. User Accounts Certain features of AllicereTV require you to create an account. When registering, you may be required to provide information including: - A username; - An email address; - A password; and - Your date of birth. You agree to provide accurate, current, and complete information and to update your information when necessary. You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not knowingly allow another person to access your account in violation of these Terms. If you believe your account has been compromised or accessed without authorization, you should contact AllicereTV as soon as reasonably possible at [Support Email Address]. 4. Passwords and Account Security AllicereTV does not intend to store your account password in plain text. Passwords are handled through our authentication infrastructure using password hashing and other appropriate security measures. AllicereTV uses reasonable technical and organizational safeguards designed to protect information maintained through the Service, which may include encryption, access controls, private storage, authentication controls, and other security technologies where appropriate. Government-issued identification documents submitted for age verification are stored in a private storage environment and are not intentionally made publicly accessible. Access to submitted identification documents is limited to authorized personnel who reasonably require access to perform the age-verification process. However, no website, network, storage system, encryption method, or electronic transmission system can be guaranteed to be completely secure. Accordingly, AllicereTV cannot guarantee that unauthorized access, disclosure, alteration, loss, or destruction of information will never occur. You are responsible for choosing a strong password and protecting your login credentials. 5. Privacy and Personal Information AllicereTV may collect and process information necessary to create and operate user accounts and provide the Service. Account information may include your username, email address, password-related authentication information, date of birth, and other information you voluntarily provide. When age verification is required, AllicereTV may also collect and process information contained in a government-issued identification document or other information submitted for the limited purpose of determining whether you satisfy the applicable age requirement. Government-issued identification may contain information such as your name, date of birth, photograph, identification number, address, and other information displayed on the document. AllicereTV uses submitted identification documents solely for the age-verification purpose described in these Terms and the Privacy Policy. AllicereTV does not intentionally use submitted government-issued identification for advertising, marketing, or unrelated profiling. Additional technical information may also be collected as necessary to operate, secure, maintain, and improve the Service. Government-issued identification submitted for age verification is subject to the following general retention procedure: 1. The Admin reviews the submission within no more than 48 hours after submission. 2. The Admin approves or rejects the submission. 3. The uploaded identification image is deleted as soon as reasonably practicable and no later than 24 hours after the decision. 4. The resulting age-verification status may be retained separately from the identification image as reasonably necessary to operate and protect the Service or comply with applicable law. Our collection, storage, processing, retention, deletion, and disclosure of personal information is further described in our Privacy Policy, which is incorporated into these Terms by reference. By using AllicereTV, you acknowledge that you have reviewed our Privacy Policy. 6. The AllicereTV Streaming Service AllicereTV provides users with access to movies, videos, programs, and other audiovisual or digital content that AllicereTV is authorized to make available. Available content may change at any time. We do not guarantee that any particular movie, program, title, feature, or other content will remain available indefinitely. Content may be added, modified, restricted, or removed without prior notice where permitted by law. We may also change, update, suspend, discontinue, or modify portions of the Service as AllicereTV develops. 7. License to Use the Service Subject to your compliance with these Terms, AllicereTV grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for lawful personal use. Unless expressly authorized by AllicereTV or permitted by applicable law, you may not: - Copy, reproduce, redistribute, rebroadcast, or publicly display content available through AllicereTV; - Download or record streaming content where downloading or recording is not expressly permitted; - Sell, rent, sublicense, or commercially exploit AllicereTV content; - Circumvent digital rights management or technological protection measures; - Attempt to obtain unauthorized access to AllicereTV systems; - Scrape or automatically collect content or data from the Service; - Reverse engineer portions of the Service except where such restrictions are prohibited by applicable law; - Share account credentials for unauthorized commercial purposes; or - Use AllicereTV to violate copyright, intellectual property, privacy, or other applicable laws. 8. Intellectual Property Unless otherwise stated, the AllicereTV website, branding, logos, graphics, software, interface, original content, design elements, and other materials owned by AllicereTV are protected by applicable intellectual property laws. Movies and other third-party content available through AllicereTV may be owned by their respective copyright holders and are provided pursuant to licenses, permissions, public-domain status, or other applicable rights. Nothing in these Terms transfers ownership of AllicereTV's intellectual property or third-party content to you. 9. Payments AllicereTV may offer paid features, subscriptions, rentals, purchases, voluntary support payments, or other payment-based functionality. The price and applicable terms of a transaction will be displayed before you authorize the transaction. By submitting payment information, you represent that you are authorized to use the selected payment method. Payments may be processed by third-party payment processors. AllicereTV may therefore not directly receive or store complete payment-card information. Additional terms or privacy policies imposed by a payment processor may apply to transactions processed through that provider. Applicable taxes, fees, or other charges may be added where required by law. 10. Voluntary Contributions to AllicereTV AllicereTV may allow users to voluntarily financially support the operation and development of the Service. Available contribution amounts may include: - $1.00 - $5.00 - $10.00 These payments are completely voluntary. AllicereTV is a for-profit business. A contribution to AllicereTV is not a charitable contribution or donation to a nonprofit or tax-exempt organization. Unless applicable law provides otherwise, contributions to AllicereTV should not be considered tax-deductible charitable donations, and AllicereTV makes no representation that a contribution will qualify for any tax deduction, credit, or other tax benefit. A voluntary contribution: - Does not represent the purchase of a physical product; - Does not provide ownership, equity, stock, voting rights, or any other financial interest in AllicereTV; - Does not constitute an investment in AllicereTV; - Does not entitle the contributor to profits, dividends, repayment, or financial returns; - Does not create a partnership, employment relationship, fiduciary relationship, or joint venture between the contributor and AllicereTV; and - Does not, by itself, provide additional streaming rights, premium content, merchandise, or other goods or services unless AllicereTV expressly states otherwise before payment. Contributions are intended solely as voluntary financial support for AllicereTV and may be used for legitimate business purposes, including operating expenses, hosting, licensing, software development, infrastructure, equipment, content acquisition, administrative expenses, marketing, employee or contractor compensation, and other expenses associated with operating or developing AllicereTV. Unless otherwise required by applicable law, voluntary contributions are final and non-refundable once processed. 11. No Investment or Ownership Interest Money provided through AllicereTV's voluntary contribution feature is not an investment. Contributors do not acquire: - Shares or equity; - Ownership rights; - Securities; - Profit-sharing rights; - Voting rights; - Rights to future revenue; - Creditor status; or - Any right to repayment. AllicereTV does not promise that a contribution will result in the development of any particular feature, acquisition of particular content, continued operation of the Service, or increase in the value of the company. 12. Refunds Refund eligibility for purchases, subscriptions, rentals, or other paid services will be governed by the refund terms presented at the time of purchase and applicable law. Except where required by law or expressly stated otherwise, voluntary contributions made solely to support AllicereTV are non-refundable. Acceptable Use You agree not to use AllicereTV to: - Violate any applicable law or regulation; - Infringe another person's intellectual property rights; - Attempt to compromise another user's account; - Upload or distribute malicious software; - Interfere with the operation or security of the Service; - Attempt to bypass access restrictions; - Manipulate, attack, overload, or disrupt AllicereTV's servers or infrastructure; - Use automated systems to access the Service in a manner not authorized by AllicereTV; - Commit fraud or engage in fraudulent payment activity; - Impersonate another individual or organization; or - Use the Service for unlawful commercial redistribution of content. We may investigate suspected violations and take appropriate action, including restricting or terminating access. 14. Account Suspension and Termination You may stop using AllicereTV at any time. AllicereTV may suspend, restrict, or terminate an account if we reasonably determine that: - You violated these Terms; - Your account is being used fraudulently; - Your account creates a security risk; - You are not legally eligible to use the Service; - You engage in unauthorized distribution or reproduction of content; - You fail to complete required age verification; - Information submitted during age verification appears fraudulent, altered, or materially misleading; - Termination is necessary to comply with law or a valid legal request; or - Continued access could materially harm AllicereTV, its users, licensors, or third parties. Where appropriate and reasonably practicable, AllicereTV may provide notice before terminating an account. 15. Third-Party Services AllicereTV may rely upon or link to services operated by third parties, including payment processors, hosting providers, content delivery networks, authentication services, analytics providers, storage providers, age-verification providers, and other technology providers. Those services may be governed by separate terms and privacy policies. AllicereTV is not responsible for third-party websites or services except to the extent required by applicable law. 16. Service Availability We work to keep AllicereTV operational but do not guarantee uninterrupted or error-free access. The Service may occasionally be unavailable because of: - Maintenance; - Software updates; - Server failures; - Internet outages; - Cybersecurity incidents; - Content licensing changes; - Third-party service interruptions; or - Circumstances outside our reasonable control. AllicereTV may modify, suspend, or discontinue all or part of the Service where permitted by law. 17. Disclaimer of Warranties TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALLICERETV AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALLICERETV DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND OTHER WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, COMPLETELY SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. Nothing in these Terms excludes warranties or rights that cannot legally be excluded. 18. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALLICERETV AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE. This includes, where permitted by law, damages resulting from loss of data, loss of profits, service interruption, unauthorized account access, or reliance upon information provided through the Service. Nothing in these Terms limits liability that cannot lawfully be limited or excluded. 19. Indemnification To the extent permitted by applicable law, you agree to indemnify and hold harmless AllicereTV and its owners, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person's rights. 20. Copyright Complaints AllicereTV respects intellectual property rights.
